Understanding Texas Personal Injury Law
In Texas, personal injury law covers any harm or damage caused to an individual due to the negligence of another party. This can include physical, emotional, and financial damages. To have a valid personal injury claim, you must establish four key elements:
- The negligent party had a duty to act with reasonable care toward you (duty of care).
- The defendant breached that duty by acting negligently (breach of duty).
- The negligence directly caused your injuries (proximate cause).
- You suffered harm as a result of the defendant’s negligence (damages).
How Long Do I Have to File a Personal Injury Claim?
Under § 16.003 of the Texas Civil Practice & Remedies Code, the statute of limitations for filing a personal injury claim is two years from the date of the accident. If you fail to file a claim within this two-year deadline, the defendant can simply file a motion to dismiss it, preventing you from recovering damages for your injuries.
What Damages Are Recoverable in Personal Injury Cases?
Wrongfully injured parties can seek to recover various types of damages in personal injury lawsuits to cover healthcare expenses, lost wages, and more. Types of recoverable damages include:
- Economic damages to compensate for financial losses, such as lost earnings, medical expenses, and property damage;
- Non-economic damages to compensate for non-financial losses, such as loss of consortium, scarring and disfigurement, pain and suffering, emotional distress, and loss of enjoyment of life; and
- Punitive damages can be awarded in certain cases involving extreme recklessness. Unlike the damages above, punitive damages are intended to punish the defendant rather than compensate the victim.
Does Texas Cap Personal Injury Damages?
A damage cap is a maximum limit on the amount of recoverable compensation in personal injury cases. While there is no cap on economic damages in personal injury cases, the state does have a cap on non-economic damages in medical malpractice lawsuits.
The Texas Civil Practice and Remedies Code specifies the following limitations for non-economic damages in medical malpractice lawsuits:
- Doctors and providers: Under §74.301(a), claimants can recover up to $250,000 in non-economic damages from individual healthcare providers.
- Single healthcare institutions: If a single medical facility, such as a hospital, is found liable in a medical malpractice lawsuit, Texas claimants can recover up to $250,000 in non-economic damages (§ 74.301(b)).
- Multiple healthcare institutions: If multiple medical institutions are found liable for medical malpractice, the claimant can recover up to $500,000 in non-economic damages (§ 74.301(c)). Keep in mind that no single healthcare facility can be liable for damages exceeding $250,000.
