What Is Modified Comparative Negligence?

Determining fault in personal injury lawsuits is rarely straightforward. From car crashes to trucking accidents, there are many instances where multiple parties may be at fault. In these cases, contributory negligence applies when the injured party (plaintiff) is partially responsible for their injuries.

Texas is a modified comparative negligence state, meaning injured plaintiffs can pursue damages even if they are partially at fault for the accident. However, victims must be less than 51% at fault to be eligible for compensation—a rule known as the “51% bar.”

Although modified comparative fault isn’t as limiting as the pure contributory negligence standard, which restricts plaintiffs from recovering any damages if they are even 1% at fault, it can still affect the outcome of your personal injury case. Working with an experienced attorney is imperative to maximize the value of your claim and recover full damages.

Proving Liability in Personal Injury Cases

Proving the mere existence of injuries isn’t enough to recover damages in a personal injury lawsuit. Because the burden of proof (the responsibility of proving liability) rests with the plaintiff, it’s essential to work with a trusted personal injury attorney who can help you navigate the legal complexities of your case.

To establish liability, the victim is responsible for proving negligence by a preponderance of the evidence. In other words, the plaintiff must prove it’s more likely than not that the defendant’s negligence directly caused the accident and ensuing injuries. Your lawyer can represent your best interests in court by establishing the four key elements necessary to recover compensation. These elements include:

  1. Duty of Care: Your lawyer must demonstrate that the defendant had a duty to act with reasonable care in the situation where the accident occurred.
  2. Breach of Duty: Next, your attorney must prove that the defendant failed to meet their standard of care, violating their responsibility to act reasonably.
  3. Causation: The plaintiff must show evidence demonstrating that the defendant’s negligent actions directly caused the accident and injuries.
  4. Damages: Lastly, your attorney must prove that you suffered injuries as a direct result of the defendant's negligence, such as medical bills or lost earnings.
