What is Nursing Home Abuse?
Nursing home abuse is an act that causes harm (not limited to just physical harm) to an elderly person living in a nursing home or assisted living facility, especially when that act is carried out by a staff member of the nursing home. Both intentional and unintentional acts can lead to abuse, too. When the harm suffered by an elderly person or senior is serious, repetitive, or caused by administrative failures, it might form the grounds to file a lawsuit against the nursing home for failing to properly care for the victim.
According to the National Council on Aging (NCOA):
- About 10% of people aged 60 or older will experience some form of elder abuse each year, many in nursing home settings.
- At the height of the COVID-19 pandemic, elder abuse reports increased (especially those related to nursing home care), and an estimated 20% of elderly people in nursing homes experienced some form of abuse.
- Only 4% of all incidents of elder abuse are reported to authorities.
The true extent of nursing home abuse is difficult to estimate, though. As mentioned, the vast majority of incidents likely never go reported, sometimes due to nursing home residents not knowing that they have the option to speak up. Another complication is that most cases remain confidential, so data and statistics are cloudy overall.
Types of Nursing Home Abuse
Although physical nursing home abuse is prevalent and dangerous, it is not the only kind of abuse that can be inflicted upon a nursing home resident. Is Nursing Home Neglect Different from Abuse?
Nursing home neglect is different from abuse in the way that abuse happens intentionally but neglect tends to happen unintentionally. The outcome is still the same: harm to an elderly person who deserved much better. For this reason, nursing home neglect can also be met with an injury claim or lawsuit.
Examples of nursing home neglect that can be harmful include failing to:
- Monitor entrances and exits, allowing nursing home residents to wander unsupervised
- Provide a nursing home resident with proper or prescribed medications
- Ensure a nursing home resident has enough food and water each day
- Keep the nursing home premises clean and hygienic
- Install and maintain handrails and other fixtures to reduce the risk of slip-and-fall accidents
- Prevent bedsores by frequently moving residents who mostly stay in bed
