Is a Mass Tort a Class Action Lawsuit?
Mass torts and class action lawsuits are two different types of cases, which are usually multidistrict litigation (MDL) types. A class action lawsuit bands all potential plaintiffs together into one class that is represented by one case. If a class action lawsuit is successful, the award or settlement is divided up (mostly) evenly among the class members. A mass tort lets plaintiffs benefit from similar or overlapping evidence, arguments, and case precedents, but they are never grouped into one class. As a result, each mass tort claim is handled individually, which also means any compensation won through a successful mass tort claim is unique to that plaintiff and their losses.
Compensation in Mass Tort Claims
Although mass torts might seem fundamentally different from the average personal injury claim, the purpose of both is the same: to get you compensation for your losses that were caused by the defendant or liable party.
